1st Circuit reverses pistol-whipping cop’s conviction

BOSTON — The First Circuit held that a federally prosecuted police officer was improperly convicted of pistol-whipping a suspect. A doctor testified as to a statement made by the suspect during a medical examination, but the suspect couldn’t be located at the time of trial and couldn’t be cross-examined about the hearsay testimony.
