2nd Circuit

IMMIGRATION, ATTORNEYS – The 2nd Circuit found that the Board of Immigration Appeals abused its discretion in rejecting the claim of an Albanian immigrant whose attorney provided him ineffective counsel. The board should consider whether petitioner’s general retainer agreement with his attorney required the attorney to inform the petitioner of a change in the filing deadlines. Order of removal vacated and remanded.
