9th Circuit revives class action over Target bed sheets

SAN FRANCISCO — The Ninth Circuit reversed the lower court’s dismissal of a putative class action against Target, which sold 100% cotton bed sheets claiming thread counts of 600 or more, which is impossible to achieve with 100% cotton textile. The lower court said that the plaintiff could not be deceived as a matter of law, but it skipped a step under analysis of the precedent found in Moore v. Trader Joe’s because it did not analyze whether the labels on the bed sheets were ambiguous as it applies to factually impossible claims.
