Acquitted of rape, still ineligible for lotto license

BOSTON — The Massachusetts Court of Appeals reversed a judgment entered against the Massachusetts lottery commission after it refused to renew a convenience store owner’s sales agent license upon learning he had been charged with, but acquitted of, raping his wife. Even though he was acquitted, the criminal trial transcripts substantially supported that he raped his wife: “Unlike in a criminal trial where the burden of proof on the commonwealth is proof beyond a reasonable doubt, the burden of proof of deficient moral character in a licensing proceeding is by a preponderance of the evidence.”
