NEW ORLEANS (CN) – The 5th Circuit upheld a Federal Trade Commission order requiring Dutch company Chicago Bridge & Iron to divest assets acquired from Pitt-Des Moines Inc. in order to increase competition in the market for industrial storage tanks and thermal vacuum chambers. Judge Dennis said the government presented detailed evidence that the two companies were the dominant suppliers in the U.S. market and had a “virtual duopoly,” making it difficult for competitors to enter the industry.
