Arizona Appeals Court

CIVIL PROCEDURE, ATTORNEYS – A nurse claimed that she slipped and fell on water while exiting the Dadeland Mall with an emergency patient. During trial the nurse’s attorney was constantly admonished from attacking the integrity of the mall’s ownership or the litigation practices of its attorneys. The appeals court ruled that a new trial is required because plaintiff’s counsel improperly accused the defense of hiding evidence during closing arguments.
