Bailiffs & bad jury instructions

MILWAUKEE — A Wisconsin federal court granted two bailiffs’ motion to certify an issue for interlocutory appeal. A man who was on trial filed a wrongful interference claim against the bailiffs after they inaccurately instructed the jury that they must reach a unanimous verdict and cannot remain deadlocked, causing them to find him guilty. An appellate court must weigh in as to when the statute of limitations’ clock began: when the trail court vacated the man’s conviction, or when the charges against him were dropped, which occurred two years apart.
