Businesses Challenge NY Bottle Bill

MANHATTAN (CN) – The International Bottled Water Association challenged a new state bottle bill that requires bottlers to put a bar code on bottles sold in New York and prohibits them from selling those bottles in other states. In their federal claim the plaintiffs, which include Nestle and Polar Corp., say the law interferes with interstate commerce.     New York enacted the New York State Returnable Container Law aka the Bottle Bill in 1982, requiring a 5-cent refundable deposit. The Legislature amended the bill in April this year. Plaintiffs, represented by Joseph Petersen with Kilpatrick Stockton, sued Gov. David Paterson, Attorney General Andrew Cuomo and three other officials.
