Class Sues Blue Cross Over Spinal Discs

LOS ANGELES (CN) – Anthem Blue Cross improperly refuses to cover artificial intervertebral discs, claiming they are “investigational,” though the FDA approved them in 2006, a class action claims in Superior Court.     Lead plaintiff Dr. Richard Hirschinger, a dentist, demands punitive damages for the class. Hirschinger says he needs a new lumbar disc, and wants the FDA-approved Pro Disc L. Anthem refused.     Plaintiffs are represented by George Kingsley.
