MANHATTAN — The Intercept’s lawsuit against OpenAI, which the investigative news outlet accuses of removing copyright management information from its articles and content, will proceed on portions of its Digital Millennium Copyright Act claims. OpenAI’s “content crawl” procedure plausibly injured The Intercept in a manner similar to typical copyright suits, the court ruled, as it implicates the news organization’s property rights in its original work as well as “the same incentives to create that justify traditional copyright” claims.
