Court records wrongly sealed

NASHVILLE, Tenn. — The Tennessee Supreme Court finds the lower courts improperly denied the Nashville Banner’s intervention to unseal three judicial records in a criminal prosecution, including two affidavits, that were sealed without a written order. Written orders are necessary, must demonstrate a compelling interest to justify the seal and must be narrowly tailored. The case is remanded to the court of criminal appeals for further proceedings.
