Don’t trust police promises

CONCORD, N.H. — The New Hampshire Supreme Court upheld a man’s DUI conviction even though he agreed to a breathalyzer test on the condition that, if his blood-alcohol content were under 0.08, he’d be let go. The two officers who made this promise did not have the authority to form a binding non-prosecution agreement with the motorist, whose BAC was 0.07.
