Eviction, for cause and retaliatory

ESSEX, Mass. — An appeals court in Massachusetts vacated a judgment of possession in favor of a landlord who evicted a tenant and her family after she reported issues with her apartment to the local board of health. The appellate court held that an eviction can be retaliatory even if it also for cause, and establishing a cause does not foreclose the family’s retaliation defense against the eviction.
