‘Farmers of color’ relief funds

CINCINNATI — The Sixth Circuit refused to rehear, en banc, a case over whether the government’s Covid-19 relief to farmers discriminated against white farmers by only permitting funds to go to “farmers of color.” A previous Sixth Circuit panel had found the government’s defense of the relief fund was “substantially justified,” then disallowed a farmer who brought the challenge from recovering attorney fees.
