International Trade Court

COMMERCE – NMB Singapore challenged a determination by the Department of Commerce to uphold an anti-dumping order for ball bearings from Japan. J. Wallach found that dumping continued above “de minimus” levels after the first order was issued, and import volumes declined over the life of the order. See ruling.           COMMERCE – NSK Corp. sought to enjoin U.S Customs and Border Protection from liquidating entries of ball bearings imported during the 18th period of review, and to force Customs to suspend liquidation of entries pending judicial review of the underlying litigation. J. Barzilay granted the injunction, ruling that NSK would be irreparably harmed and will likely succeed on the merits. See ruling.
