NEW ORLEANS (CN) – A pre-paid legal service company failed to prove it was damaged by a Mississippi lawyer’s solicitation of its members for potential lawsuits against the company, the **5th Circuit ruled. A three-judge panel upheld dismissal of a lawsuit filed by **Pre-Paid Legal Services against attorney Barry Gilmer . Pre-Paid claimed Gilmer used newspaper advertisements to recruit litigants. He allegedly inked contracts with 432 people who responded to the ads and filed nine complaints on their behalf. See ruling.
