Maine can pursue 10th Amendment suit against NOAA

BANGOR, Maine. — A Maine federal court is allowing Maine and its Department of Marine Resources to proceed with their lawsuit against the National Oceanic and Atmospheric Administration, which terminated a $9 million award granted to the department for “a project intended to restore tidal salt marsh habitat and protect coastal infrastructure from flooding.” NOAA’s termination of the award was a coercive action that violates Maine’s sovereignty and 10th Amendment rights in retaliation for its governor’s defiance of an executive order prohibiting trans girls from participating in school sports.
