A man dismissed from the University of Virginia School of Medicine after asking questions during a panel on microaggressions may pursue his First Amendment retaliation claim against various individuals at the school, because he has alleged sufficient facts to show that his comments were protected speech, were not made at inappropriate times or places and were not “disruptive or offensive,” a federal court in the state ruled.
