DENVER (CN) – Aurora Organic Dairy, facing numerous class actions accusing it of falsely claiming its milk is organic, has been sued by four insurance companies that disclaim their responsibility to defend it. Lead plaintiff ACE American Insurance claims it insured Aurora for bodily injury and property damage, which do not apply, and for personal and advertising injury, which do not apply either. This federal lawsuit disclaims responsibility to defend or indemnify Aurora in a class action filed in St. Louis Federal Court, apparently, the Mothershead case. (The plaintiff attorney’s printer apparently could not print the letters “f” and “d,” which makes reading the filing somewhat difficult.) The insurers’ lead counsel is Garrick Gallagher with Sanders & Parks of Phoenix.
