DALLAS — Provista, a health care group purchasing organization (GPO), beat an antitrust lawsuit filed in Texas federal court by the seller of disposable medical supplies, which says Provista and its related Vizient companies have engaged in anticompetitive behavior in the course of negotiating sales and prices for members of its network. The court says the claims misapprehend the relevant market, likening Provista to a burger chain, saying it is not the case that “Whataburger violates the Sherman Act by serving 100% of its customers and having a loyalty program.”
