PLANO, Texas — Texas won a preliminary injunction in federal court, halting the Department of Labor’s implementation of a new rule that would raise the salary threshold for the Fair Labor Standards Act’s executive, administrative, and professional employee exception from overtime pay. Texas is likely to prevail on its argument that the exemption “turns on consideration of an employee’s duties, not her salary.”
