Oyster-catcher loses claims

BOSTON — The Massachusetts Court of Appeals affirmed the lower court’s decision to grant summary judgment in favor of the commonwealth and against a fisherman who was catching and selling wild oysters to wholesalers. He “was acting in his capacity as a commercial fisherman, and not as a Native American exercising his right to fish for sustenance.”
