Photographer Tells Pharmacy to Knock It Off

BIRMINGHAM, Ala. (CN) – A professional photographer say CVS Caremark pharmacies help customers duplicate his copyrighted photos and kept doing it after replying to his cease and desist letter by assuring him it would stop.     Rob Fleming, of Demopolis, Ala., claims CVS “readily and without question or hesitation” duplicated his copyrighted photos, even though its employees knew it was illegal.     Fleming claims CVS’s “senior legal counsel” responded to his attorney’s cease and desist letter by saying that the company had “strict protective measures to safeguard against copyright infringement” and would “retrain the staff” so that the violation would “not occur again.”     But CVS kept on duplicating his copyrighted photos, Fleming says.     He wants damages for 22 violations, and he wants CVS ordered to circulate a memo every quarter reminding its employees not to photocopy copyrighted works.      He is represented in Federal Court by James Moncus III.
