PHILADELPHIA — The Third Circuit revived Smith & Wesson’s suit challenging the New Jersey attorney general’s subpoena enforcement action against it, finding the lower court did have jurisdiction to hear the claims. The subpoena seeking documents relating to the company’s advertising in New Jersey is part of the state’s investigation of the company for possible violations of the New Jersey Consumer Fraud Act.
