SpaceX appeal blows up

NEW ORLEANS — The Fifth Circuit dismissed SpaceX’s appeal of a Texas federal court decision that, the Musk corporation argues, took too long to rule on its motion for a preliminary injunction against the National Labor Relations Board. But SpaceX’s own efforts to challenge a decision transferring the case from Texas to California was the source of the delays, and they did not result in some “serious ... consequence” required for an immediate appeal.
